Autopass Terms of Use
Version 1.0 — effective on publication
These terms are a contract between you and AUTOPASS PARKING LLC ("Autopass", "we", "us"). They apply when you use app.autopassparking.com, the Autopass mobile app, or pay for parking through an Autopass QR code or link.
By paying for parking or creating an account, you accept these terms. If you do not accept them, do not use the service.
1. What Autopass is
Autopass lets you pay for parking at lots in our network. We are not the parking operator. Each lot is owned and run by an independent operator who sets the rates, the hours, the rules of the lot, and the consequences of breaking them. We provide the payment and verification service on their behalf.
This matters in one practical way: a paid Autopass session covers the space, the vehicle, and the time you paid for. It is not permission to ignore the signs at the lot.
2. Your account
You must be at least 18, or old enough to enter a binding contract where you live. Keep your password to yourself; you are responsible for what happens under your account until you tell us it has been compromised. Give us accurate information and keep it current.
3. Your vehicle and plate
You are responsible for the plate you enter. Enforcement at these lots works by reading plates. A plate typed wrongly, or a session started for the wrong vehicle, will not protect the car you actually parked, and a parking notice issued in that situation is not something we can cancel on your behalf.
Check the plate before you pay. If you photograph it, check what we read back.
4. Paying
- The price shown before you confirm is the price you pay, including any service fee and applicable tax.
- Paying authorises us, through our payment processor, to charge your chosen payment method for that session.
- Saving a card authorises us to charge it for later sessions you start.
- If a charge fails or is reversed, the parking session may be treated as unpaid and enforced accordingly.
Refunds. Parking is delivered as soon as the session starts, so sessions are generally not refundable. We will refund a duplicate charge, a charge for a session that never started, or an amount charged in error. Anything to do with the lot itself — a space that was blocked, a gate that did not open, a rate that was posted wrongly — is the operator's to resolve, and we will pass your request to them.
5. Confirming you are at the lot
Before taking payment we may check that you are where you say you are, using any of: your device's location, a check with your mobile carrier that your phone is near the lot, and the lot's licence-plate cameras.
Two things follow from that:
- We may decline a payment when those checks say the vehicle is not at the lot. If that happens to you in error, move into the lot and try again, or use the contact below.
- A check passing is not a promise. These signals confirm presence; they do not verify that you are entitled to the space, that you are within the lot's posted hours, or that you have chosen the right rate. That remains yours.
6. Parking notices and disputes
Parking notices are issued by the operator or its enforcement provider, not by Autopass. If you receive one for a session you paid through Autopass, tell us and we will provide the payment record. Whether the notice stands is decided by the operator and its own dispute process, under the terms posted at the lot.
7. Using the service properly
Do not use Autopass to pay for a vehicle you have no right to park, misrepresent a plate, interfere with the service or its verification checks, attempt to reach accounts or data that are not yours, or use it for anything unlawful. We may suspend or close an account that does.
8. Availability
We aim to keep Autopass running, but we do not promise it will be uninterrupted or error-free. Maintenance, outages, connectivity, and third-party failures happen. If Autopass is unavailable, you are still responsible for paying for your parking by whatever means the lot provides.
9. Our content
The Autopass software, brand, and content belong to us or our licensors. You get a personal, non-transferable, revocable licence to use the service as intended. Nothing here transfers ownership.
10. Disclaimers and limits
To the fullest extent the law allows, the service is provided "as is" and "as available", without warranties of any kind.
To the fullest extent the law allows, our total liability to you for any claim relating to the service is limited to the greater of (a) the amounts you paid us through Autopass in the twelve months before the claim, or (b) US $100. We are not liable for indirect, incidental, or consequential loss, including lost profits, loss of use of a vehicle, or amounts assessed by a parking operator.
Some jurisdictions do not allow these exclusions; where that is so, they apply only as far as the law permits.
11. Indemnity
You will indemnify us against claims arising from your use of the service in breach of these terms, or from a vehicle or plate you entered that you had no right to use.
12. Changes
We publish a new version rather than editing the old one, and every earlier version stays available. The version in force is always the one shown at app.autopassparking.com/legal/terms. Continuing to use Autopass after a new version takes effect means accepting it; if you do not, stop using the service and close your account.
13. Ending it
You may close your account at any time. We may suspend or end your access if you break these terms, if we are required to, or if we stop offering the service. Sums already owed survive, as do sections 9 through 15.
14. Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The state and federal courts sitting in Broward County, Florida have exclusive jurisdiction, and you and we each consent to that venue.
15. Everything else
If any part of these terms is unenforceable, the rest stands. Our not enforcing something is not a waiver of it. These terms, plus the Privacy Policy, are the whole agreement between us about the service. You may not assign them; we may, to a successor to our business.
